AirMerica Heating and Cooling, LLC
Last Updated: September 24, 2026
These Terms and Conditions apply to HVAC services, repairs, maintenance, equipment sales, and installations provided by AirMerica Heating and Cooling, LLC (“AirMerica,” “we,” “us,” or “our”). By authorizing AirMerica to perform work, the customer (“Customer” or “you”) acknowledges and agrees to the applicable terms below.
1. Customer Authorization
Customer represents that they are the owner of the property or have authority from the property owner to authorize the requested work. Customer authorizes AirMerica and its employees, technicians, subcontractors, and authorized representatives to access the property as reasonably necessary to inspect, diagnose, service, repair, maintain, or install HVAC equipment.
Customer is responsible for providing safe and reasonable access to equipment and work areas.
2. Estimates and Scope of Work
Any estimate or proposal provided by AirMerica is based upon conditions reasonably observable at the time of inspection. Additional problems or conditions may be discovered after work begins.
Work outside the original scope will not be performed without Customer authorization when additional approval is reasonably required.
Unless specifically stated otherwise in writing, estimates do not include repairs or modifications necessitated by concealed conditions, pre-existing defects, structural deficiencies, electrical or plumbing issues, environmental conditions, code requirements not reasonably identifiable before work begins, or work performed by other contractors.
3. Payment
Customer agrees to pay AirMerica according to the payment terms stated on the applicable estimate, proposal, invoice, or agreement.
Payment is due upon completion of service unless different payment terms have been agreed to in writing.
Customer remains responsible for amounts due for authorized work regardless of whether reimbursement is expected from an insurance company, property manager, homeowners’ association, home warranty company, financing company, or other third party, unless AirMerica expressly agrees otherwise in writing.
4. Financing
AirMerica may provide customers with access to third-party financing options, including financing offered through FTL Finance.
AirMerica Heating and Cooling, LLC is not a lender and does not make credit or financing decisions. All financing approvals, denials, interest rates, fees, repayment terms, credit requirements, and other financing terms are determined solely by the applicable third-party financing provider.
Customer is responsible for reviewing and agreeing to the financing provider’s separate terms and conditions.
5. Equipment and Manufacturer Warranties
New HVAC equipment may include warranties provided by the equipment or component manufacturer. Manufacturer warranties are subject to the manufacturer’s terms, conditions, exclusions, registration requirements, and limitations.
AirMerica does not control manufacturer warranty determinations and cannot guarantee that a manufacturer will approve a warranty claim.
Unless AirMerica expressly provides a separate written labor warranty, manufacturer warranties should not be interpreted as covering AirMerica labor, diagnostic charges, refrigerant, shipping, processing, or other costs not specifically covered by the manufacturer.
6. Existing Equipment and Conditions
HVAC systems consist of interconnected mechanical, electrical, refrigerant, drainage, ductwork, thermostat, and other components. Servicing or replacing one component may reveal problems with another component that could not reasonably have been identified beforehand.
AirMerica is not responsible for pre-existing defects or failures, concealed conditions, improper prior installations or repairs, deteriorated components, existing leaks, damaged ductwork, electrical deficiencies, plumbing or drain problems, mold or microbial growth, structural problems, or other conditions not caused by AirMerica’s work.
7. Customer Maintenance Responsibilities
Customer is responsible for reasonable maintenance of HVAC equipment, including replacing or cleaning filters as appropriate, maintaining unobstructed equipment areas, keeping condensate drainage systems reasonably maintained, and operating equipment according to manufacturer recommendations.
Damage or system failure caused by neglect, misuse, lack of maintenance, unauthorized modifications, improper operation, or work performed by another person or contractor may not be covered by an applicable AirMerica labor warranty.
8. Permits and Code Requirements
When permits or inspections are required for work performed by AirMerica, they will be handled as specified in the applicable proposal or agreement.
Existing portions of a property or HVAC system may not comply with current building, electrical, mechanical, or other codes. Unless specifically included in AirMerica’s scope of work, AirMerica is not responsible for correcting unrelated pre-existing code deficiencies.
If an authority having jurisdiction requires additional work beyond the original scope, AirMerica will notify Customer when reasonably practicable. Additional work may result in additional charges.
9. Property Access and Work Areas
Customer agrees to provide AirMerica with safe and reasonable access to the property, HVAC equipment, electrical panels, thermostats, attics, closets, garages, roofs, crawl spaces, and other areas reasonably necessary to perform authorized work.
Customer should remove or protect valuables, furniture, personal property, and other items located near the work area.
AirMerica will use reasonable care while performing work but is not responsible for damage resulting from pre-existing deterioration, unsafe or inaccessible conditions, hidden utilities or structures, or conditions that could not reasonably have been discovered before work began.
10. Events Outside AirMerica’s Control
AirMerica is not responsible for delays, failures, or damages caused by circumstances outside its reasonable control, including severe weather, hurricanes, flooding, power outages or power irregularities, equipment or parts shortages, manufacturer delays, supply-chain disruptions, acts of government, fire, theft, vandalism, pests or animals, or other events beyond AirMerica’s reasonable control.
11. Limitation of Liability
To the fullest extent permitted by applicable law, AirMerica shall not be liable for indirect, incidental, special, exemplary, or consequential damages arising from HVAC equipment failure or AirMerica’s services.
To the fullest extent permitted by applicable law, AirMerica’s liability arising from a particular service, repair, or installation shall not exceed the amount Customer paid AirMerica for the work giving rise to the claim.
Nothing in these Terms is intended to waive or limit any right or remedy that cannot legally be waived or limited under applicable law.
12. Cancellations
Customer cancellation rights, if any, will be governed by the applicable written agreement and federal, state, and local law.
When a transaction qualifies for a statutory cancellation period, AirMerica will honor the Customer’s cancellation rights as required by applicable law.
Special-order equipment, materials, permits, completed work, emergency services, and other items may be subject to different cancellation requirements to the extent permitted by law and as disclosed in the applicable agreement.
13. Service Scheduling
Appointment times and arrival windows are estimates unless AirMerica expressly agrees otherwise.
AirMerica may need to reschedule or adjust arrival times because of emergency calls, unexpected conditions at earlier jobs, weather, traffic, equipment availability, technician availability, or other circumstances.
AirMerica will make reasonable efforts to communicate material scheduling changes.
14. Photos and Documentation
AirMerica may photograph or otherwise document HVAC equipment, model and serial numbers, installation conditions, completed work, and related areas of the property for legitimate business purposes, including service records, warranty documentation, permitting, quality control, and documentation of work performed.
15. Third-Party Work
AirMerica is not responsible for work performed by other contractors, technicians, homeowners, property managers, manufacturers, utility companies, or other third parties.
Modification, alteration, or repair of AirMerica’s work by another party may affect any applicable AirMerica labor warranty.
16. Website Information
Information provided on AirMerica’s website is intended for general informational purposes. Website content is not a substitute for an on-site evaluation and does not constitute a binding estimate, diagnosis, warranty, or promise regarding a particular HVAC system.
Prices, services, promotions, equipment availability, and other website information may change without notice.
17. Privacy and Communications
Information provided to AirMerica may be used as reasonably necessary to respond to inquiries, schedule appointments, provide estimates and services, process transactions, communicate regarding work performed or requested, and maintain business records.
If AirMerica separately offers promotional text messaging or other marketing communications requiring consent, applicable consent and opt-out terms will be provided in connection with that program.
18. Governing Law
These Terms and any services provided by AirMerica shall be governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles.
19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
20. Entire Agreement
These website Terms and Conditions supplement the specific estimate, proposal, invoice, financing agreement, warranty, or other written agreement applicable to Customer’s work.
If a specific written agreement between AirMerica and Customer contains terms that conflict with these general website Terms and Conditions, the terms of the specific written agreement will control with respect to that particular transaction.
